Senate Rejects CS Chirchir’s Tactic, Calls for Transparency in JKIA-Adani Project

Kisii Senator Richard Onyonka has revealed a growing tension between Senate leaders and the Cabinet Secretary (CS) for Roads and Transport, Davis Chirchir, over the controversial JKIA-Adani Public Infrastructure Investment Project (PIIP). The project, which involves a partnership with India’s Adani Group, has faced increasing scrutiny due to concerns over mismanagement and lack of transparency.

In a recent Senate session, Chirchir attempted to use a legal rule, known as subjudice, to avoid discussing the details of the project. The subjudice rule prevents discussing matters that are currently before the courts to ensure that public debates do not influence legal proceedings.

However, many Senators, including Onyonka, saw this as an attempt by Chirchir to dodge the Senate’s questions and delay the release of critical documents relating to the project.

The Senate was not convinced by Chirchir’s reasoning. Onyonka and his colleagues moved quickly to reject the subjudice defense, stating that it was not a valid reason to avoid their questions. 

The Senate made it clear that the need for transparency was too important to be ignored, especially given the scale and significance of the JKIA-Adani project.

After Chirchir’s failed attempt to shield the project under the subjudice rule, the Senate decided to adjourn the session. However, before ending the meeting, the Senate ordered that all documents related to the project must be submitted by the end of the day. 

These documents are expected to provide detailed information about the financial dealings, contracts, and regulatory approvals associated with the project.

Senators have expressed concerns that the project, which is meant to improve infrastructure at Jomo Kenyatta International Airport (JKIA), may not be following the proper procedures.

There are fears that the lack of transparency could lead to financial losses for the country or result in poor execution of the project, impacting the airport’s future operations.

The demand for the documents is a sign of the Senate’s determination to get to the bottom of the matter. The project has already sparked public debate, with many Kenyans concerned about whether the partnership with Adani is in the best interest of the country.

The Senate has scheduled another session for tomorrow, where Chirchir will return to face more questioning. The CS is expected to provide clear answers about the project’s status, its financial arrangements, and whether it meets all necessary legal and regulatory requirements.

Onyonka’s role in bringing the issue to the forefront has raised expectations that the Senate will not allow the matter to be swept under the rug. As more details come to light, there is hope that the Senate’s intervention will help ensure that the project is managed in a way that benefits the country.

This Senate investigation could have far-reaching implications for the JKIA-Adani PIIP. If the documents reveal any irregularities or mismanagement, it could lead to a halt in the project or even legal action against those involved. The Senate’s firm stance also sends a strong message that the government must be held accountable, especially when it comes to large infrastructure projects that involve public funds.
