Rigathi Gachagua Lines His Defense Lawyers as He Prepares for Impeachment Trial

Deputy President Rigathi Gachagua is facing a significant legal challenge as he prepares for his impeachment trial in Parliament. The trial, set for October 8, 2024, comes after a group of MPs allied with President William Ruto introduced a motion to remove him from office.

The MPs accuse Gachagua of stirring ethnic tensions and undermining the government, leading to a serious political showdown. To defend himself, Gachagua has assembled a team of five top lawyers to lead his defense and secure his acquittal.

1. Paul Muite

Paul Muite is leading Gachagua’s legal team. He is a senior lawyer with over 50 years of experience and is widely respected in Kenya’s legal field. Muite has built a reputation for handling some of the most important legal cases in the country.

One of his most notable cases was representing the Independent Electoral and Boundaries Commission (IEBC) during the 2017 General Elections. He also defended the four IEBC commissioners, famously known as the "Cherera 4," who were ousted after the 2022 elections.

Muite is no stranger to impeachment cases, having successfully defended former Embu Governor Martin Wambora in an impeachment trial. His deep knowledge of constitutional law makes him a key figure in Gachagua’s defense strategy.

2. Victor Swanya

Victor Swanya is another key lawyer on Gachagua’s defense team. Swanya is a well-known figure in Kenya’s legal community and has represented a wide range of clients, including politicians and business figures. 

He has built a strong reputation for handling both criminal and political cases. In reference to Gachagua’s case, Swanya has expressed his confidence, stating that they have thoroughly reviewed the accusations against the Deputy President and are fully prepared to defend him.

Swanya’s expertise in handling politically sensitive cases will be important in navigating the complex dynamics of Gachagua’s impeachment trial.

 3. Tom Maina Macharia

Tom Maina Macharia, who heads the law firm MAM Advocates, is also part of the defense team. Macharia is known for his expertise in civil litigation, and his law firm is regarded as a top player in legal services for corporations.

His work spans areas such as real estate, banking, and environmental law. Macharia is ranked in Band 4 by Chambers and Partners, a respected global legal research company, for his technical skills, professional conduct, and dedication to his clients.

Macharia’s background in civil litigation will bring a different dimension to Gachagua’s defense, helping address legal technicalities that may arise during the trial.

4. Amos Kisilu

Amos Kisilu, founder of Kisilu & Company Advocates, is also on the team. Kisilu is known for his aggressive and relentless approach to litigation. He specializes in personal injury and financial law cases and has built a strong reputation for winning compensation for his clients. His fighting spirit and experience in court battles make him an important asset to Gachagua’s defense team.

Kisilu’s tough approach is expected to help the team in responding to the serious allegations raised by the MPs.

5. Elisha Ongoya

Rounding out the team is Elisha Ongoya, a senior advocate of the High Court of Kenya and a partner at Ongoya & Wambola Advocates. Ongoya is also a private law expert and a lecturer at Kabarak University. His background in teaching and legal research gives him a unique perspective, allowing him to approach the case with a mix of academic knowledge and practical legal experience.

Ongoya’s expertise in private law will be valuable in shaping the arguments presented in Gachagua’s defense during the trial.
