"Will He Be Lucky?" Gachagua Files Another Motion Seeking To Stop Impeachment Proceedings

On October 15, 2024, Deputy President Rigathi Gachagua filed a notice of motion in court to stop the impeachment proceedings against him. 

His lawyer, Paul Muite, presented this request to a three-judge bench, claiming that the National Assembly had acted illegally in the process of trying to oust Gachagua.

Muite argued that the Senate should not proceed with the impeachment until the court reviews the alleged illegalities raised in the case. 

He expressed the urgency of their request, stating, "We are anxious today. We are seeking to persuade this court to issue a conservatory order so that the illegality and constitutional resolution by the National Assembly does not proceed."

However, this is not the first time Gachagua has sought to stop the impeachment. Earlier, Justice Chacha Mwita declined to issue similar orders, which means the Senate may continue its discussions on the impeachment motion despite Gachagua's legal efforts.

Senate Speaker Amason Kingi has previously made it clear that the Senate cannot be stopped by court orders. He noted that Parliament must continue its work, regardless of any legal challenges, stating that "no court order can stop proceedings before the Senate." 

This ruling has raised concerns for Gachagua and his supporters, as they fear that the impeachment process might advance without resolving the legal issues first.

The Deputy President has consistently defended himself against the accusations that led to the impeachment motion. 

He believes that there are forces in the government trying to remove him from office unfairly. Gachagua described the impeachment attempt as a "microwave impeachment," suggesting that it is being rushed without proper consideration.

The court's decision on Gachagua's latest motion could have significant implications for his political future. 

If the Senate continues the proceedings, Gachagua may face serious challenges in keeping his position.

 However, if the court rules in his favor, it could delay the impeachment process and provide Gachagua with more time to prepare his defense.

As the situation develops, many are watching closely to see how it will unfold and what it means for the leadership in Kenya.
