Nelson Havi, the former President of the Law Society of Kenya (LSK), has called for the removal of all seven judges of Kenya's Supreme Court, including Chief Justice Martha Koome.
In a petition submitted to the Judiciary Service Commission (JSC) on January 13, 2025, Havi accused the judges of serious misconduct, including corruption and failure to provide proper leadership to the judiciary.
Havi has urged the JSC to advise President William Ruto to establish a tribunal to investigate the judges and possibly dismiss them from office.
He specifically named Chief Justice Koome, along with Justices Philomena Mwilu, Mohammed Ibrahim, Smokin Wanjala, Njoki Ndung'u, Isaac Lenaola, and William Ouko, as the subjects of his complaint.
Havi's petition highlights his frustration with the judges' conduct and their failure to uphold the integrity of the judiciary.
The petition follows Havi's ultimatum to the Supreme Court judges, which was issued a day earlier.
On January 12, 2025, he gave the six judges a 24-hour deadline to convince CJ Koome to resign.
If they failed to do so, Havi vowed to take action, calling for the removal of all seven judges.
He set the deadline for January 14, 2025, and warned that he would submit the petition to the JSC if no action was taken.
A major point of contention for Havi is his belief that CJ Koome has failed to lead the judiciary effectively, especially when compared to her predecessor, Evans Gicheru.
He also referred to a controversial ruling in 2022 in which Havi, along with senior counsel Ahmednasir Abdullahi, was banned from appearing before the Supreme Court.
This decision, according to Havi, was part of a broader pattern of judicial overreach and improper conduct by the current bench.
Havi has expressed personal anguish over the decision to call for the judges' removal, particularly because one of the judges is his mother.
Despite this emotional challenge, he insists that the actions of the Supreme Court judges have compromised the integrity of the institution.
