The ruling was delivered on Thursday, February 13, 2025, by Milimani Anti-Corruption Court Chief Magistrate Thomas Nzioki.
Waititu was found guilty of corruption-related charges, including irregularly awarding tenders in Kiambu County during his time as governor in 2018.
The court sentenced him to five years in prison or pay a fine of Ksh2.5 million. Additionally, he was given a mandatory fine of Ksh51 million. If he fails to pay, he will serve an extra seven years in jail.
His wife, Susan Wangare, was also found guilty and sentenced to one year in prison or pay a fine of Ksh500,000.
However, the magistrate ruled that their sentences would run concurrently.
Court Blames Waititu for Misusing Public Funds
While delivering the ruling, Magistrate Nzioki stated that Waititu had betrayed public trust.
The court found that he and his co-accused deliberately misused county funds for personal gain instead of serving the people.
“This case is a clear example of public trust being broken. The accused persons benefited from their actions, which affected service delivery to the people,” the magistrate said.
Other Officials Also Sentenced
The court also sentenced Luka Mwangi Wahinya, the former Chief Officer for Roads in Kiambu County.
He was given two years in prison or a fine of Ksh1 million. Additionally, he was fined Ksh20 million, failing which he would serve another five years in jail.

Charles Chege Mbuthia and Beth Wangeci Mburu, directors of Testimony Enterprises Limited, were also convicted.
Chege was sentenced to four years in prison or pay a fine of Ksh2 million, plus a mandatory fine of Ksh294 million. Wangeci received a three-year sentence or a fine of Ksh1.4 million.
Court Bars Waititu from Public Office
The court also ruled that Waititu, his wife, and the other accused should not hold public office for ten years. The magistrate further criticized them for forging academic documents.
Waititu and his co-accused have been given 14 days to appeal the ruling.
