Nelson Havi Predicts Imminent Impeachment of Speaker Moses Wetang’ula After Court Ruling

Nelson Havi, the former president of the Law Society of Kenya (LSK), has hinted that Moses Wetang'ula, the Speaker of the National Assembly, may soon be impeached.
This prediction comes after a series of legal and political developments that have put Wetang'ula’s leadership under scrutiny.
His dual role as Speaker and leader of the Ford Kenya party has sparked controversy, especially after a ruling from a three-judge bench of the High Court.
The court decision, delivered recently, declared that Wetang'ula could not hold the position of Speaker while serving as the leader of a political party.
This ruling came after concerns that Wetang'ula’s leadership in Ford Kenya could create a conflict of interest, especially when making decisions in Parliament.
According to the court, Wetang'ula’s affiliation with a political party might make his rulings biased, especially in cases involving political parties or coalitions.
The court also raised concerns about his involvement in decisions such as the declaration that the Kenya Kwanza coalition, led by President William Ruto, was the majority side in the House, a decision that went against the opposition Azimio La Umoja coalition.
The ruling has intensified calls for Wetang'ula to step down. A section of lawmakers from the Azimio coalition, including key figures from the Orange Democratic Movement (ODM), have publicly demanded that Wetang'ula resign as Speaker.
They argue that his continued hold on the position is a conflict of interest and undermines the integrity of the Parliament.
They specifically point to his involvement in the Kenya Kwanza versus Azimio debate, claiming that his position as a party leader compromises his ability to be neutral.
In the face of growing pressure, Wetang'ula has refused to step down. On February 11, 2025, during a sitting in the National Assembly, Wetang'ula dismissed the calls for his resignation.
He stated that no formal motion had been presented in Parliament to address his removal and that, according to the court ruling, there was no recommendation that he must leave office.
He also suggested that the calls for his resignation were politically motivated and based on party rivalry rather than legal grounds.
Despite Wetang'ula’s resistance, Nelson Havi believes his time as Speaker is running out. In a tweet on February 11, 2025, Havi suggested that the ODM party would soon seek revenge on Wetang'ula after their messy fallout in the past.
Havi predicted that the impeachment motion against Wetang'ula could be tabled in Parliament within days.
He added that even members of the UDA party, President Ruto’s party, would not be able to save Wetang'ula this time.
This statement from Havi has fueled the speculation that Wetang'ula’s position as Speaker is in serious jeopardy.
If ODM and other opposition members bring forward an impeachment motion, it would force a vote in Parliament. For Wetang'ula to remain Speaker, he would need to secure the support of a majority of MPs, including those from the ruling Kenya Kwanza coalition.
